What are the chances of getting guardianship of my mom? She lives in another state, and has been stuck in a very bad nursing home by her 30 year younger husband, he is just waiting for her to die. There is no estate , I just want her to receive the best care she can. He will not even allow another Dr to see her. I am appearing in court DEC 3rd. what are my chances.
Essentially you should be able to put enough factual information in their hands on the court date to cause them to ask for an evaluation. How is your mom's mental status - can she speak for herself?

i know a bad nursing home in fla . it was a errie feelin to be in that place , hated it , my brother was talkin about puttin dad there i freaked out sai doh no no ure not ! so he is here indiana with me in my home , safe and sound and with love too ....
If your mother is legally married (God help her) to this guy, thirty years her junior, the court will probably honor his wishes about her care. You have to take HIM to court and show cause why he should be removed as guardian. This is a lot of work and usually does not work out. The best you can hope for is to ask him to remove her to a different nursing home.
