My son has had 4 months to get a job and on unemployment and his wife has a 30 hour job at walmart. They are rude and mean to me and I told them I want them out by august. I need to know how to evict them because they have no drive to leave MY home. I stay out all day because it is crowded. Im sick and tired of this.

Since you are in Mesa Arizona, you are in Maricopa County. You mosey down to the sheriff's office and ask them to remove someone who is abusing you and ask for an order of protection to keep them away.

Don't take this as legal advice, but I've had to evict someone I was living with once, because he lost his job, lost his car, refused to help himself, and became abusive. We were renting an apartment together. He was contributing nothing financially. He needed cigarettes one day, so he asked me for money and my truck keys. I gave him some cash and told him to walk. Knowing he didn't have his apartment key with him, I simply locked him out. When he returned, I refused to open the door. He called management. They refused to unlock the door since I was the one paying the rent and I was standing right in front of it. He called the police dept. They tried to initimidate me. I asked them if they would arrest me if I didn't open the door. They said no. I said ok, then I'm not opening the door. They offered him a ride to the YMCA. The next day he returned with someone from the Sheriff's Dept. Again, they couldn't force me to open the door. He wanted his belongings, but he had no way to transport them or any place to put them. I told him to let me know when he had a way to transport his belongings and a place to put them. I put his belongings in a storage unit and waited for him to contact me. I got a notice from the court that he was suing me for his belongings. I brought a list of his belongings and the receipts from the storage unit rental. The judge made him pay me for storing his items and then he was allowed access to the storage unit. IF you need to/choose to do this, make sure you store ONLY their items in the storage unit. I wouldn't recommend this method, and it may be illegal in some states, and since you're dealing with family, the reprecussions might be never-ending, but in Ohio, dealing with someone I wanted out of my home and out of my life completely, it worked. Best of luck in getting rid of your unwelcome roommates.

I think that you are being extremely generous by saying August. Be sure that they know whether it's August 1 or August 31. Until the day comes that you have said and then, of course they won't be out, I don't think you can begin the eviction process. However, nothing can stop you from investigating it. Call the county (not 911) and ask the person who answers the phone to help you out. That you need to know what the process is and how to begin.

Other than being mean and lazy and not contributing to the household, are they abusive to you physically? If they are, I would step up the timeline and not wait until August. If they are, or become abusive, call the police and tell them. Good luck!

Check out these links:

Call the clerk of the court and ask what papers you need, how they need to be signed (witnessed, notarized or not), how service needs to be made (I doubt you will be able to serve your son and DIL yourself), filing and service fees (if a sheriff's deputy has to make service), etc.

This is the best place to get information as this would be the court that would handle the eviction.

Frankly, I wouldn't give them until August. They probably will have a certain amount of time after you serve them with eviction papers, so it's wise to get the process started now to stop the aggravation you're experiencing.

In the meantime, I'd remove any valuable papers or items you have in the house, just in case. It doesn't sound as if they're very cooperative, and who knows what they'll do when you evict them.

You might also want to talk to the local police to see if they can be available when the process server or sheriff makes service. It could be that they'll become hostile and may have to be removed immediately by police if they become violent. So protect yourself.
