I just need one lil piece of information but I cried myself to sleep mom sleeps so she don't hear me...I cant even see my eyes hurt so bad....and I cant seem to find this answer easily. could anyone here help me?

I got her files yesterday it was supposed to include the two complaints the 'PATIENT ADVOCATE' had assured me had been addressed.... she assured me! she would get it taken care of...when mom's treatment was botched
I told her clearly my job is to take care of my mom your job is to take care of me! she agreed and promised it would be handled...so I get a phonecall week later. they have made a thorough investigation and found no wrong doing on hsptl part
so I want those records and they tell me I do not have a right to them?

But you have the proper POA? I'm not familiar with what happened so I'm just asking.

If you do, then why wouldn't you have a right to them the same as to your own?
I've never tried to see my own records or my mom's, so I don't know how resistant anyone would be. I kind of suspect no one is encouraged to look at their medical records but no first hand experience with that.

Is a personal injury lawyer an option?

jujubean - I'm not totally understanding your question, but if you have Health Care POA on your mom, you should be able to give the hospital or doctor's office a copy of it and they should give you a copy of your mom's patient records. The hospital or doctor's office may also require your mom sign a HIPPA form just to cover them. I've done this with my mother-in-law before. Good luck!!

yes they gave me medical records but I had specifically asked for the patient advocate complaints they have received from me...the records on the report and review and results...etc..'

they are telling me I have no right to my own complaint records ughhh

the report was on a doctor not doing his job they dismissed it as no wrong doing, well come to find out she had an L1lumbar fracture and i have been dragging her around trying to get her to stand for 5 wks....it is the 3rd time on same injury screwed it up ...i want to take them to task on this...i want to see that it was reported and reviewed and cleared as she states! and she is refusing me a copy of the report sez confidential...

That's terrible about your mom!!! Personally, I would be contacting a personal injury lawyer a.s.a.p. and see if they can help you with this because I believe you're right that it sounds like they're running damage control. It sounds like the doctor needs to be set right by a lawyer. Good luck!!

ya but can you believe it I have been thru this with dad....it is nearly impossible to get a lawyer to take a case on the elderly...no punatine,,,no profit I am ashamed to say I have done this once before and couldn't win but this time Is different! idk...I just emailed them and sed lemme know today in writing what you need for those records to be put in my hands....
luck be with me or ??? they accidently emailed me back and internal saying basically this one is gonna be a problem for us ...where are files. and an attachment of some kind of dictation is attached...
this could be a good thing for us too I wish I could get the attatchment open I was gonna call my computer guy or GP maybe they on same software idk...
